Terms of Service for PicsFold

1. Acceptance of These Terms

By downloading, installing, accessing, or using PicsFold, you agree to these Terms of Service and to the PicsFold Privacy Policy.

If you do not agree to these terms, do not use PicsFold. If you use PicsFold on behalf of another person or organization, you represent that you have authority to accept these terms on their behalf.

2. What PicsFold Does

PicsFold is a local-first photo organization app. It lets you take, import, store, organize, view, manage, export, share, and delete photos and related metadata on your device.

PicsFold is not a backup service, cloud storage service, archive service, emergency storage system, professional records system, legal evidence system, medical records system, financial records system, or guaranteed preservation system.

3. Your Responsibility for Your Content

You are solely responsible for the photos, videos, files, folder names, metadata, notes, exports, shared files, and any other content you create, import, store, organize, delete, export, or share through PicsFold.

You are responsible for:

• Keeping independent backups of any content that matters to you
• Checking that imports, exports, edits, deletions, and shares worked as expected
• Managing your device storage, operating system settings, permissions, and backups
• Protecting your device, passcode, biometric access, and cloud accounts
• Making sure your content is lawful and does not violate anyone’s rights
• Understanding the consequences of deleting, moving, exporting, sharing, or modifying files

Do not rely on PicsFold as the only place where an important photo, document, memory, receipt, record, assignment, work file, legal file, or other valuable content exists.

4. No Warranty

To the maximum extent permitted by law, PicsFold is provided without any warranty of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that PicsFold will be uninterrupted, secure, error free, accurate, complete, compatible with every device, compatible with every operating system version, available forever, suitable for any particular purpose, or free from defects, crashes, bugs, data loss, corruption, delays, sync issues, permission issues, storage issues, import failures, export failures, deletion mistakes, display errors, metadata errors, thumbnail errors, camera errors, location errors, purchase issues, analytics issues, crash reporting issues, notification issues, or any other malfunction.

We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, reliability, availability, and security, to the maximum extent permitted by law.

5. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages, losses, costs, expenses, claims, or liabilities arising from or related to PicsFold or these terms.

This includes, without limitation, liability for:

• Lost, deleted, damaged, corrupted, duplicated, misplaced, modified, exposed, or inaccessible photos, videos, files, metadata, folders, albums, thumbnails, exports, or backups
• Accidental deletion, accidental sharing, accidental import, accidental export, accidental overwrite, accidental edits, accidental organization, or accidental disclosure
• Device malfunction, app malfunction, operating system malfunction, storage malfunction, permission malfunction, camera malfunction, location malfunction, payment malfunction, analytics malfunction, crash reporting malfunction, network malfunction, or third-party service malfunction
• Security incidents, unauthorized access, device theft, account compromise, passcode compromise, biometric access misuse, malware, spyware, cloud backup exposure, or local device exposure
• Loss of memories, sentimental value, business records, academic records, professional records, legal records, medical records, financial records, receipts, evidence, work product, opportunities, revenue, profits, goodwill, reputation, time, productivity, or convenience
• Emotional distress, frustration, embarrassment, inconvenience, interruption, delay, reliance, misinterpretation, or disappointment
• Use of or inability to use PicsFold, whether caused by bugs, crashes, updates, design decisions, discontinued features, compatibility changes, platform rules, account issues, purchase issues, device limitations, user error, or anything else

This limitation applies even if we have been advised of the possibility of such damages and even if any remedy fails of its essential purpose.

6. Maximum Liability Cap

To the maximum extent permitted by law, if we are found liable for any claim related to PicsFold or these terms, our total aggregate liability will be limited to the greater of the amount you paid directly for PicsFold in the three months before the event giving rise to the claim or 10 United States dollars.

Some jurisdictions do not allow certain limitations of liability. In that case, the limitation will apply to the fullest extent permitted by applicable law.

7. Backups, Data Loss, and Deletion

PicsFold may store data locally on your device. Local data can be lost for many reasons, including app bugs, user action, device failure, operating system behavior, storage cleanup, uninstalling the app, changing devices, restoring from backup, failed backup, interrupted import or export, low storage, file system issues, permissions changes, or third-party software.

You are solely responsible for maintaining separate backups outside PicsFold. We are not responsible for any loss, deletion, corruption, or unavailability of your content.

8. User Conduct

You agree not to use PicsFold to:

• Violate any law, regulation, court order, contract, or third-party right
• Create, store, import, export, or share unlawful, harmful, abusive, exploitative, infringing, or non-consensual content
• Invade privacy, harass, impersonate, defame, threaten, or harm another person
• Bypass, interfere with, reverse engineer, modify, or misuse PicsFold or related services
• Upload or distribute malware, spyware, or harmful code through any sharing or export workflow
• Use PicsFold in a way that could damage our reputation, systems, users, platforms, or service providers

You are responsible for ensuring you have all rights and permissions needed for any content you handle with PicsFold.

9. Third-Party Platforms and Services

PicsFold may interact with third-party platforms, services, tools, and operating system features, such as app stores, payment processors, camera APIs, photo library APIs, location services, maps, sharing sheets, cloud backups, crash reporting, analytics, device storage, and other apps.

We do not control third-party platforms or services and are not responsible for their availability, behavior, policies, security, pricing, purchases, refunds, errors, outages, data handling, content, or decisions.

10. Purchases, Subscriptions, and Refunds

If PicsFold offers paid features, subscriptions, trials, or in-app purchases, those transactions may be processed by the App Store, Google Play, or another platform provider.

Prices, taxes, renewal rules, cancellation rules, refund decisions, billing failures, family sharing, purchase restoration, and account eligibility may be controlled by the relevant platform provider. We are not responsible for platform billing decisions or payment provider errors.

11. Updates, Changes, and Availability

We may update, modify, suspend, remove, limit, rename, redesign, or discontinue PicsFold or any feature at any time, with or without notice.

Updates may introduce bugs, remove behavior you rely on, change file handling, change compatibility, require a newer operating system, or affect your workflow. You are responsible for deciding whether to install updates and for backing up your content before doing so.

12. Privacy

The PicsFold Privacy Policy explains how PicsFold handles local data, optional crash reporting, and optional analytics.

13. Intellectual Property

PicsFold, including its design, software, branding, text, graphics, interfaces, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

These terms do not transfer ownership of PicsFold to you. Subject to your compliance with these terms, you receive a limited, revocable, non-exclusive, non-transferable license to use PicsFold for personal or internal use.

14. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Onur Arda Öz from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from or related to your use of PicsFold, your content, your violation of these terms, your violation of law, or your violation of any third-party rights.

15. No Professional Advice

PicsFold does not provide legal, medical, financial, tax, safety, archival, security, photography, forensic, compliance, or professional advice. Any organization or display features are for convenience only.

You are responsible for obtaining professional advice before relying on any photo, file, metadata, export, or organization workflow for important decisions.

16. Termination

You may stop using PicsFold at any time. We may suspend or terminate access to PicsFold or related services if we believe you have violated these terms, created legal risk, or misused the app.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, and dispute-related provisions.

17. Governing Law

These terms are governed by the laws applicable in the developer’s place of residence, without regard to conflict of law rules, unless applicable consumer protection law requires otherwise.

If any provision of these terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted to the maximum extent permitted by law.

18. Changes to These Terms

We may update these Terms of Service from time to time. If we make important changes, we may notify users in the app or update the “Last updated” date above.

Your continued use of PicsFold after changes means you accept the updated terms.
